Welcome to The Pickleball Universe (“we,” “our,” “us”). By accessing or using our website www.ThePickleballUniverse.com, booking our courts, purchasing memberships, or participating in our events, you agree to these Terms of Service (“Terms”). Please read them carefully before using our services.

1. Acceptance of Terms

By using our website or services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our services.

2. Founding & Charter Membership Guarantee

1. Lifetime Rate Protection:
Founding Members and Charter Members (“Charter Members”) are guaranteed that their membership fee will remain fixed at the original rate paid at the time of enrollment. TPU will not increase Charter Members’ membership fees for the lifetime of their membership, provided they remain in good standing.

2. Indoor Facility Inclusion:
Founding and Charter Members’ benefits automatically extend to TPU’s indoor facility once it opens, without an additional membership fee increase for life.

3. Good Standing Requirement:
To maintain this guarantee, Charter Members must keep their membership active, current, and in good standing (e.g., no lapses in payment, compliance with TPU rules and policies).

Non-Transferability:
Charter Memberships are personal to the individual and non-transferable.

3. Eligibility

You must be at least 12 years old or have the consent of a parent or legal guardian, to use our services.

4. Services Provided

We offer pickleball court bookings, memberships, lessons, clinics, events, and related products or services, as described on our website. We reserve the right to modify, suspend, or discontinue any service at any time.

5. Account Registration

Some services may require you to create an account. You agree to provide accurate information and keep your account secure. You are responsible for all activity that occurs under your account.

6. Payments & Refunds

We are a cashless venue

All prices are listed in U.S. dollars and are subject taxes.
Payments must be made in full at the time of booking or purchase.
Refunds or credits, if applicable, are subject to our posted refund policy.

7. Booking & Cancellation Policy

Court reservations, lessons, or event bookings are subject to availability. Cancellations or rescheduling must follow our posted policy. Late arrivals may result in shortened playtime or forfeiture without refund. Membership cancellations are done by the member in the reservation system portal and can be done at any time or by TPU for a non-payment of Membership dues.

8. Code of Conduct

By participating in The Pickleball Universe activities, you agree to:

Follow all posted rules and staff instructions.
Treat other players, guests, and staff with respect.
Refrain from disruptive, unsafe, or illegal behavior.

We reserve the right to remove any person from our premises or events for violating these rules without refund and terminate their membership.

9. Waiver & Release of Liability

By participating in our activities, you acknowledge that pickleball and related activities involve inherent risks of injury. You voluntarily assume all risks and agree to release and hold harmless The Pickleball Universe, its owners, staff, and affiliates from any claims related to injury, loss, or damage.

10. Intellectual Property

All content on our website, including logos, graphics, photos, and text, is owned by The Pickleball Universe and protected by copyright, trademark, and other laws. You may not use our content without written permission.

11. Prohibited Uses

You may not use our services or website for any unlawful purpose or to engage in conduct that violates these Terms.

12. Third-Party Services

We may use third-party providers for payments, scheduling, or other functions. These providers have their own terms and policies, which you should review separately.

13. Disclaimer of Warranties

Our services are provided “as is” and “as available” without warranties of any kind, express or implied.

14. Limitation of Liability

To the maximum extent permitted by law, The Pickleball Universe is not liable for any indirect, incidental, or consequential damages arising from your use of our services.

15. Indemnification

You agree to indemnify and hold harmless The Pickleball Universe from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

16. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on our website with a new effective date.

17. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.

18. Closures

The Pickleball Universe may close part or all of the facility for private events.

Return and Refund Policy

The Pickleball Universe

At The Pickleball Universe, we value our members and guests and strive to provide the best possible playing and social experience. To ensure fairness and clarity, we have established the following return and refund policy for reservations and events.

Court Reservations

Cancellations Outside 72 Hours:
Reservations cancelled more than 72 hours in advance will incur no cancellation fees, and any prepaid amounts will be refunded in full or credited back to the member’s account.
Cancellations Within 72 Hours:
Reservations cancelled within 72 hours of the scheduled time are non-refundable and will count towards your weekly allotment.. Credits or refunds will not be issued unless due to an unforeseen facility closure initiated by TPU.
No-Shows:
Failure to show up for a reservation without cancellation will result in a full charge and will count towards your weekly allotment, with no refund or credit.

Private Events & Facility Buyouts

A 50% deposit is required at the time of booking.
Deposits are non-refundable if cancelled within 14 days of the event date.
Cancellations 15 days or more before the event will receive a full refund of the deposit.
If TPU must cancel the event due to unforeseen circumstances (e.g., facility issues), all deposits and payments will be refunded in full.

Leagues, Clinics & Programs

Registrations cancelled 7 or more days prior to the start date will receive a full refund or account credit.
Cancellations made within 7 days of the start date are non-refundable, but TPU may, at its discretion, allow credit toward a future program.
Once a program has begun, no refunds will be issued.

Merchandise

Unused/unworn merchandise in original condition may be returned within 14 days of purchase for a full refund or exchange.
Sale or clearance items are final sale and non-refundable.
